2. Scope

3.1 Data Protection

3. Digital Products & E-Learning Courses
Our courses are delivered in digital format and are considered “digital content” under UK law.
A. Cancellation Before Access
If you have not accessed the course materials, you may cancel your order within 14 days of purchase for a full refund.
B. Cancellation After Access
If you have accessed or downloaded the digital course materials, you acknowledge that your right to cancel is waived under the Consumer Contracts Regulations. However, we may offer refunds at our discretion in cases of:
Technical issues preventing access (where the fault is on our side).
Course content being materially different from the description.
4. Bespoke Content Development
Where we create custom training content specifically for you, cancellations are subject to the following:
If work has not started, you may cancel within 7 days for a full refund.
If work has started, you will be charged for the proportion of work completed at the time of cancellation.

6. Processing of Refunds
Approved refunds will be processed to your original payment method within 14 working days.
We will confirm via email once your refund has been issued.

8. Content Subscription – Means subscribing to the Fyre Learning library, paid annually
Annual subscriptions are not entitled to cancellation or refund unless explicitly outlined by the company directors. For renewal, cancellation must be given in writing at least 60 days before the renewal date, unless explicitly approved by the company directors.
1. Availability
1.1 Fyre Learning Limited (“the Supplier”) shall use reasonable endeavours to ensure the Hosted Services are available 99% of the time, measured each calendar month.
This uptime target shall be met if there are no Priority 0 or Priority 1 incidents outstanding.
Downtime during scheduled maintenance (as outlined in paragraphs 1.2 – 1.3 below) or during agreed installation periods for new products is excluded from the target uptime calculation.
2. Maintenance
1.2 The Supplier will from time to time provide and install:
Maintenance Releases: Minor improvements, updates, enhancements, error corrections, upgrade scripts, and changes to the Supplier Software.
New Versions: New releases, versions, updates, and modifications to the Supplier Software that do not constitute New Products (in line with our release schedule, available on request, and including updated help files and documentation).
1.3 Nothing in this SLA entitles the Client to any New Product, defined as a version containing significant differences from previous versions such that it is considered a new product in the marketplace.
3. Support
1.4 For errors in the Hosted Services and/or Supplier Software reported to our helpdesk (see 1.9 – 1.10), we will provide the service levels detailed in 1.12 – 1.15, provided these errors are not Out of Scope.
1.5 Out of Scope means errors resulting from:
Misuse or improper use of the Hosted Services and/or Supplier Software.
Use of the Hosted Services and/or Supplier Software with hardware or software outside the Client’s Infrastructure and/or Connectivity Infrastructure.
1.6 Out of Scope issues may be supported as additional Services under a separate Statement of Work (SOW).
4. Environment
1.7 The Client is responsible for procuring and maintaining their Infrastructure and Connectivity Infrastructure.
1.8 Maintenance Releases or New Versions may require enhancements to the Client’s infrastructure. The Supplier will advise if such upgrades are required, but the Client is responsible for procuring and implementing them. The Supplier can assist under a separate SOW if required.

6. Service Levels
1.12 When an incident is reported, the Supplier will:
Assign a unique support number.
Determine whether the incident is within scope (see 1.4).
Categorise the incident (see 1.15).
Work to provide Solutions within the stated response times.
1.13 Solutions may be fixes or workarounds that remove the issue or reduce its severity level. Solutions are provided remotely and may include Maintenance.
1.14 If a Solution reduces an incident’s priority, the new response times apply from the re-categorisation point.
